persona juridik\u00eb t\u00eb huaj rezident\u00eb n\u00eb Bashkimin Evropian dhe vendet an\u00ebtare t\u00eb OECD, si dhe personat juridik\u00eb t\u00eb huaj rezident\u00eb n\u00eb shteteve t\u00eb cilat nuk jan\u00eb an\u00ebtare t\u00eb BE-s\u00eb dhe OECD, t\u00eb cil\u00ebt n\u00eb kushte t\u00eb reciprocitetit, mundet t\u00eb marrin t\u00eb drejt\u00ebn e pron\u00ebsis\u00eb t\u00eb t\u00eb interesuar dor\u00ebtojn\u00eb k\u00ebrkes\u00eb p\u00ebr pjes\u00ebmarrje n\u00eb ankandit pblik n\u00eb m\u00ebnyr\u00eb elektronike, p\u00ebrmes sistemit informativ t\u00eb vendosur n\u00eb ueb faqen www.gradezno-zemjiste.mk, me plot\u00ebsimin e formularin elektronik q\u00eb e n\u00ebnshkruajn\u00eb me certifikat\u00eb digjitale t\u00eb vlefshme t\u00eb l\u00ebshuar nga dh\u00ebn\u00ebs i autorizuar. Tab.1, do t\u00eb filloj\u00eb n\u00eb dat\u00ebn 16.10.2024, n\u00eb ora 14:00 dhe e njejta do t\u00eb zgjas\u00eb 15 minuta.<br>PROCEDURA<\/li>\n\n\n\n<li>Komisioni njofton parashtryesit e aplikimit p\u00ebr kompletimin e dokumenteve t\u00eb tyre ne m\u00ebnyr\u00eb elektronike, n\u00eb afat prej 24 or\u00ebve nga skadimi i afatit p\u00ebr paraqitjen e tyre, p\u00ebr \u00e7ka parashtryesve t\u00eb aplikimit t\u00eb cil\u00ebt kan\u00eb dor\u00ebzuar aplikime t\u00eb plota ju dor\u00ebzon em\u00ebr shfrytezues dhe fjal\u00ebkalim p\u00ebr pjes\u00ebmarje n\u00eb ankand publik,nd\u00ebrsa aplikant\u00ebve q\u00eb nuk kan\u00eb dor\u00ebzuar dokumentacionin e plot\u00eb u dor\u00ebzon njoftim me arsyetim se t\u00eb nj\u00ebtit nuk do t\u00eb marrin pjes\u00eb n\u00eb ankand publik.<\/li>\n\n\n\n<li>N\u00eb dit\u00ebn e mbajtjes s\u00eb ankandit publik elektronik, pjes\u00ebmarr\u00ebsit hyjn\u00eb n\u00eb faqen e internetit me emrin e p\u00ebrdoruesit dhe fjal\u00ebkalimin q\u00eb mor\u00ebn n\u00eb adres\u00ebn e post\u00ebs elektronike, bashkangjitur k\u00ebrkes\u00ebs p\u00ebr pjes\u00ebmarrje n\u00eb ankandin publik.<\/li>\n\n\n\n<li>Ankandi publik elektronik do t\u00eb mbahet edhe n\u00ebse n\u00eb shpallje \u00ebsht\u00eb paraqitur nj\u00eb pjes\u00ebmar\u00ebs, p\u00ebr secil\u00ebn parcel\u00eb nd\u00ebrtimore n\u00eb ve\u00e7anti i cili i plot\u00ebson kushtet e k\u00ebrkuara n\u00eb shpallje dhe e rrit\u00eb \u00e7mimin fillestar.<\/li>\n\n\n\n<li>Ankandi publik elektronik e ndjek Komisioni, i formuar nga Kryetari i Komun\u00ebs s\u00eb B\u00ebrvenic\u00ebs.<\/li>\n\n\n\n<li>Ankandi publik elektronik fillon me shpalljen e \u00e7mimit fillestar t\u00eb tok\u00ebs p\u00ebr met\u00ebr katror, dhe kryhet me an\u00eb t\u00eb ankandit publik nga pjes\u00ebmarr\u00ebsit n\u00eb ankand publik.<\/li>\n\n\n\n<li>Ankandit publik p\u00ebr parcel\u00ebn nd\u00ebrtimore n\u00eb Tabel\u00ebn 1 kryhen &#8220;hap pas hapi&#8221; duke rritur vler\u00ebn me secilin &#8220;hap&#8221; jo m\u00eb pak se 10,00 denar\u00eb\/m2.<\/li>\n\n\n\n<li>Ankandi publik elektronik llogaritet i p\u00ebrfunduar n\u00eb momentin e mbarimit t\u00eb koh\u00ebs t\u00eb p\u00ebrcaktuar n\u00eb k\u00ebt\u00eb shpallje, p\u00ebr \u00e7ka n\u00eb qoft\u00eb se pas p\u00ebrfudimit t\u00eb 2 minutave nga ana e pjes\u00ebmarsve me ofert\u00ebn e dh\u00ebn\u00eb, afati I fundit p\u00ebr p\u00ebrfundimin e ankandit publik vazhdohet edhe p\u00ebr 2 minuta. Ankandi publik vazhdon pa kufi deri sa n\u00eb afat kohor prej 2 minuta kemi ofert\u00eb t\u00eb re.<\/li>\n\n\n\n<li>Pjes\u00ebmar\u00ebsi ne ankand publik i cili ka ofruar \u00e7mimi m\u00eb t\u00eb lart\u00eb do t\u00eb marr\u00eb statusin e ofertuesit m\u00eb t\u00eb volitsh\u00ebm.<\/li>\n\n\n\n<li>Komisioni pas p\u00ebrfundimit t\u00eb ankandit publik, p\u00ebrgatit procesverbalin p\u00ebr zbatimin e ankandit publik dhe n\u00eb m\u00ebnyr\u00eb elektronie e d\u00ebrgon deri tek t\u00eb gjith\u00eb pjes\u00ebmarr\u00ebsit n\u00eb ankandin publik.<\/li>\n\n\n\n<li>Pas p\u00ebrfundimit t\u00eb procedur\u00ebs s\u00eb ankandit publik, Komisioni detyrohet n\u00eb afat prej tre dit\u00ebve pune, t\u00eb dor\u00ebzoj k\u00ebrkes\u00eb p\u00ebr mendim deri te Prokurori Shtet\u00ebror i Republik\u00ebs s\u00eb Maqedonis\u00eb s\u00eb Veriut, n\u00eb raport me propozim tekstin e kontrat\u00ebs p\u00ebr tjet\u00ebrsimin e tok\u00ebs nd\u00ebrtimore n\u00eb pron\u00ebsi t\u00eb Republik\u00ebs s\u00eb Maqedonis\u00eb s\u00eb Veriut. Prokurori Shtet\u00ebror i Republik\u00ebs s\u00eb Maqedonis\u00eb s\u00eb Veriut \u00ebsht\u00eb i obliguar t\u00eb dor\u00ebzoj\u00eb mendim p\u00ebr propozim tekstin e kontrat\u00ebs p\u00ebr tjet\u00ebrsimit, n\u00eb afat prej 30 dit\u00ebve nga pranimi i k\u00ebrkes\u00ebs p\u00ebr mendim. N\u00ebse n\u00eb afat prej 30 dit\u00ebve Prokuroria Shtet\u00ebrore e Republik\u00ebs s\u00eb Maqedonis\u00eb s\u00eb Veriut nuk dor\u00ebzon mendim, do t\u00eb konsiderohet si pozitiv.<\/li>\n\n\n\n<li>Pas pranimit t\u00eb mendimit pozitiv nga Prokuroria Shtet\u00ebrore e Republik\u00ebs s\u00eb Maqedonis\u00eb s\u00eb Veriut, Komisioni n\u00eb afat prej tre dit\u00ebve t\u00eb pun\u00ebs ofertuesit m\u00eb t\u00eb volitsh\u00ebm i dor\u00ebzon njoftim p\u00ebr zgjedhjen e ofertuesit m\u00eb t\u00eb volitsh\u00ebm.<\/li>\n\n\n\n<li>Ofertuesit m\u00eb i volitsh\u00ebm \u00ebsht\u00eb i obliguar n\u00eb afat prej 15 dit\u00ebve nga pranimi i njoftimit p\u00ebr zgjedhjen e ofertuesit m\u00eb t\u00eb volitsh\u00ebm, t\u00eb paguaj\u00eb mjetet, n\u00eb pajtueshm\u00ebri me \u00e7mimin e fundit t\u00eb aritur n\u00eb ankand dhe harxhimet e procedur\u00ebs, n\u00eb vler\u00eb prej 10% nga vlera e garancioni bankar p\u00ebr seriozitetin e ofert\u00ebs. por jo m\u00eb shum\u00eb se 15.000,00 denar\u00eb dhe deri te komisioni t\u00eb dor\u00ebzoi d\u00ebshmi p\u00ebr pages\u00ebn e realizuar me t\u00eb gjith\u00eb dokumentacionin e nevojshme p\u00ebr pjes\u00ebmarrje n\u00eb ankand publik n\u00eb origjinal.<\/li>\n\n\n\n<li>N\u00eb rast se ofertuesi m\u00eb i volitsh\u00ebm nuk i paguan mjetet dhe nuk e dor\u00ebzon dokumentacionin e duhur p\u00ebr pjes\u00ebmarje n\u00eb ankand publik n\u00eb afatin e caktuar, nuk do t\u00eb lidhet kontrata, garancioni bankar do t\u00eb aktivizohet dhe i njejti nuk mund t\u00eb mer pjes\u00eb n\u00eb ankandet e ardhshme publike p\u00ebr parcel\u00ebn e lart\u00ebp\u00ebrmendur.<\/li>\n\n\n\n<li>N\u00eb rast se ofertuesi m\u00eb i volitsh\u00ebm i paguan mjetet n\u00eb afatin e caktuar, kurse n\u00eb baz\u00eb t\u00eb dokumentacionit t\u00eb dor\u00ebzuar nuk mund t\u00eb lidhet kontrata, mjetet nuk i kthehen, garancioni bankar p\u00ebr seriozit\u00ebt t\u00eb ofert\u00ebs aktivizohet dhe kontrata nuk do t\u00eb lidhet .<\/li>\n\n\n\n<li>Pas dor\u00ebzimit t\u00eb d\u00ebshmis\u00eb p\u00ebr pages\u00ebn e realizuar dhe dorizmit t\u00eb dokumentacionit t\u00eb plot\u00eb t\u00eb nevojsh\u00ebm p\u00ebr pjesmarje n\u00eb ankand publik, n\u00eb afat prej 5 dit\u00eb pune Kryetari I komun\u00ebs s\u00eb B\u00ebrvenic\u00ebs lidh kontrat\u00eb p\u00ebr tjet\u00ebrsim t\u00eb tok\u00ebs nd\u00ebrtimore n\u00eb pron\u00ebsi s\u00eb Republik\u00ebs s\u00eb Maqedonis\u00eb s\u00eb Veriut. Kontrata lidhen n\u00eb form\u00eb elektronike n\u00ebp\u00ebrmjet sistemit elektronik p\u00ebr tok\u00ebn nd\u00ebrtimore.<\/li>\n\n\n\n<li>Pas lidhjes s\u00eb kontrat\u00ebs Komuna e B\u00ebrvenic\u00ebs n\u00eb afat prej 1 dite n\u00eb m\u00ebnyre elektronike e dor\u00ebzon kotnrat\u00ebn p\u00ebr p\u00ebrcaktimin e tatimit n\u00eb shitblerje t\u00eb patundshm\u00ebrive. Bler\u00ebsi \u00ebsht\u00eb i obliguar n\u00eb afat prej 15 dit\u00ebsh nga pranimi i Aktvendimit p\u00ebr tatim n\u00eb qarkullim t\u00eb patundshm\u00ebrive t\u00eb paguaj tatimin dhe ta dor\u00ebzoj dh\u00ebshmi p\u00ebr tatimin e paguar.<\/li>\n\n\n\n<li>Pas dor\u00ebzimin e d\u00ebshmis\u00eb p\u00ebr tatimin e paguar, bler\u00ebsi n\u00eb afat prej 30 dit\u00ebsh kontrat\u00ebn n\u00eb m\u00ebnyr\u00eb elektronike e dor\u00ebzon n\u00eb notar p\u00ebr solemnizim. Bler\u00ebsi \u00ebsht\u00eb i boliguar solemnizimin t\u00eb realizoj n\u00eb afat 30 dit\u00ebsh nga dor\u00ebzimi i kontrat\u00ebs n\u00eb noterin kompetent.<\/li>\n\n\n\n<li>N\u00ebqoft\u00ebse bler\u00ebsi me fajin e tij n\u00eb afat caktuar prej 1 dit nuk e dor\u00ebzon kontrat\u00ebn p\u00ebr p\u00ebrcaktim t\u00eb tatimin n\u00eb qarkullim t\u00eb patundshm\u00ebrive d\u00ebri te Komuna e B\u00ebrvenic\u00ebs, dhe gjithashtu me fajin e tij nuk e paguan tatimin n\u00eb qarkullim n\u00eb afatin e caktuar prej 15 dit\u00ebsh, dhe t\u00eb njejtin nuk e dor\u00ebzon p\u00ebr solemnizim te noteri komptent n\u00eb afat prej 30 dit\u00ebsh dhe nuk e kryen slemnizimin e kontrat\u00ebs n\u00eb afat prej 30 dit\u00ebsh, I njejti nj\u00ebansh\u00ebm do t\u00eb prishet dhe 80 % e shum\u00ebs s\u00eb p\u00ebrgjithshme p\u00ebr tjet\u00ebrsim nuk do ti kthehet bler\u00ebsit.<\/li>\n\n\n\n<li>Me kontrat\u00ebn ofertuesi m\u00eb i volitsh\u00ebm (bler\u00ebsi) detyrohet n\u00eb afat prej 9 muajsh nga solemnizimi i kontrat\u00ebs t\u00eb siguroj\u00eb leje nd\u00ebrtimi p\u00ebr objektin e parashikuar n\u00eb pajtueshm\u00ebri me planin urbanistik n\u00eb baz\u00eb t\u00eb t\u00eb cilit toka \u00ebsht\u00eb e tjet\u00ebrsuar, p\u00ebr parcelat nd\u00ebrtimore me sip\u00ebrfaqe deri 5000 m2, gj\u00ebgj\u00ebsisht n\u00eb afat prej 12 muajsh nga solemnizimi i kontrat\u00ebs p\u00ebr parcelat nd\u00ebrtimore mbi 5000 m2.<\/li>\n\n\n\n<li>N\u00eb rast se l\u00ebnd\u00eb e kontrat\u00ebs \u00ebsht\u00eb toka shtet\u00ebrore e rregulluar ofertuesi m\u00eb i volitsh\u00ebm (bler\u00ebsi) \u00ebsht\u00eb i obliguar t\u00eb nd\u00ebrrtoj objektin n\u00eb pajtueshm\u00ebri me dispozitat e Ligjit p\u00ebr nd\u00ebrtim, n\u00eb pajtueshm\u00ebri me kategorizimin e nd\u00ebrtimeve.<\/li>\n\n\n\n<li>N\u00eb \u00e7mimin e tok\u00ebs nd\u00ebrtimore nuk p\u00ebrfshihet kompenzimi p\u00ebr rregullimin e tok\u00ebs nd\u00ebrtimore,<\/li>\n\n\n\n<li>N\u00eb rast se bler\u00ebsi nuk siguron leje nd\u00ebrtimi n\u00eb afatin e caktuar, gjegj\u00ebsisht n\u00ebse objekti nuk nd\u00ebrtohet n\u00eb afatin e caktuar p\u00ebr fajin e bler\u00ebsit, i njejti do t\u00eb ket\u00eb obligim t\u00eb paguaj d\u00ebnim me marveshje n\u00eb lart\u00ebsi prej 1.5 % nga cmimi total I ariturn\u00eb ankandin publik n\u00eb tok\u00ebn l\u00ebndore p\u00ebr secilin muaj t\u00eb kaluar n\u00eb vitin e par\u00eb nga skadimi I afatit, gjegj\u00ebsisht 3 % nga cmimi total I ariturn\u00eb ankandin publik n\u00eb tok\u00ebn l\u00ebndore p\u00ebr secilin muaj t\u00eb kaluar n\u00eb vitin e dyt\u00eb nga skadimi I afatit, gjegj\u00ebsisht 4.5 % nga cmimi total I ariturn\u00eb ankandin publik n\u00eb tok\u00ebn l\u00ebndore p\u00ebr secilin muaj t\u00eb kaluar n\u00eb vitin e tret\u00eb dhe p\u00ebr secilin muaj t\u00eb kaluar n\u00eb t\u00eb tretin dhe secilin vit t\u00eb ardhsh\u00ebm nga skadimi afatin.<br>23.Mos plot\u00ebsimi i obligimeve gjegj\u00ebsisht pas vones\u00ebs s\u00eb bler\u00ebsit n\u00eb vones\u00ebn me plot\u00ebsimin e obligimeve 3 muaj t\u00eb nj\u00eb pas nj\u00ebshme paraqet baz\u00eb tjet\u00ebrsuesi, pas tre thirjeve t\u00eb nj\u00eb pas nj\u00ebshme mujore p\u00ebr realizim, si i besuesh\u00ebm me deklarat\u00eb p\u00ebr mos plot\u00ebsimin e obligimeve nga kontrata t\u00eb k\u00ebrkoj\u00eb v\u00ebrtetim p\u00ebr ekzekutim t\u00eb kontrat\u00ebs gjegj\u00ebsisht t\u00eb k\u00ebrkoj\u00eb pages\u00eb p\u00ebr d\u00ebnimin me marveshj\u00eb, \u00e7ka paraqet dhe baz\u00eb p\u00ebr prishje t\u00eb nj\u00eb anshme t\u00eb kontrat\u00ebs, p\u00ebr \u00e7ka 80 % nga shuma e p\u00ebrgjithshme e tjet\u00ebrsimin nuk i kthehen bler\u00ebsit.<br>24.Prishja e kontrat\u00ebs p\u00ebr shkak t\u00eb mosplot\u00ebsimin t\u00eb obligimeve t\u00eb kontrat\u00ebs nga ana e bler\u00ebsit realizohet me deklarat\u00eb t\u00eb vullnetshme t\u00eb nj\u00eb anshme t\u00eb tjet\u00ebrsuesit e deklaruar nga ana e Komun\u00ebs p\u00ebrmes Prokurorit shtet\u00ebror\u00eb t\u00eb Rebulik\u00ebs s\u00eb Maqedonis\u00eb s\u00eb Veriut, gjegj\u00ebsisht obligim I bler\u00ebsit p\u00ebr pages\u00ebn e tatimit n\u00eb qarkulim dhe harxhimet e noterit n\u00eb rast t\u00eb prishjes s\u00eb kontrat\u00ebs me faj t\u00eb bler\u00ebsit, bien n\u00eb ngarkes\u00eb t\u00eb bler\u00ebsit.<br>25.P\u00ebrqindja minimale q\u00eb duhet t\u00eb nd\u00ebrtohet nga sip\u00ebrfaqja e p\u00ebrgjithshme e zhvilluar p\u00ebr nd\u00ebrtim e parapar\u00eb me planin urbanistik p\u00ebr parcel\u00ebn l\u00ebndore nuk mund t\u00eb jet\u00eb me e vogel se 30 %.<br>26.Pronari I tok\u00ebs nd\u00ebrtimore t\u00eb siguruar n\u00eb procedur\u00eb p\u00ebr tjet\u00ebrsismin m\u00eb ankand publik nuk mund t\u00eb njejt\u00ebn ta bart n\u00eb persona t\u00eb tret\u00eb para plot\u00ebsimit t\u00eb obligimeve nga kontrata p\u00ebr tjet\u00ebrsimin e t\u00eb njet\u00ebs. Ndalimi p\u00ebr bartjen n\u00eb personat e tret\u00eb regjistrohet n\u00eb librat publik p\u00ebr regjistrimin e t\u00eb drejtave t\u00eb patundshm\u00ebris\u00eb, n\u00eb t\u00eb kund\u00ebrt\u00ebn e njejta paraqet baz\u00eb p\u00ebr prishjen e nj\u00ebanshme t\u00eb kontrat\u00ebs, p\u00ebr \u00e7ka 80 % nga shuma e p\u00ebrgjithshme e tjet\u00ebrsimin nuk I kthehen bler\u00ebsit. Me p\u00ebrjashtim n\u00eb qoft\u00ebse pornari I tok\u00ebs nd\u00ebrtimore \u00ebsht\u00eb person juridik I jasht\u00ebm, toka nd\u00ebrtimore e siguruar n\u00eb procedur\u00eb p\u00ebr tjet\u00ebrsismin me ankand public mund ta bart\u00eb n\u00eb pron\u00ebsi te personi juridik vendasn\u00eb t\u00eb cilin person I jasht\u00ebm I huaj juridik me doemos t\u00eb jet\u00eb pronar I vet\u00ebm deri n\u00eb momentin e plot\u00ebsimin e obligimeve n\u00eb kontrat\u00ebn e tjet\u00ebrsimin t\u00eb tok\u00ebs nd\u00ebrtimore me ankand publik .<br>27.Toka nd\u00ebrtimore n\u00eb pron\u00ebsi t\u00eb Republik\u00ebs s\u00eb Maqedonis\u00eb s\u00eb Veriut, e cila \u00ebsht\u00eb l\u00ebnd e shpalljes deri n\u00eb plot\u00ebsimin e obligimeve t\u00eb kontrat\u00ebs nuk mund t\u00eb jet\u00eb pjes\u00eb mas\u00ebs likuduese.<br>28.Ofertuesi m\u00eb i volitsh\u00ebm (Bler\u00ebsi) obligohet t\u00eb paguj tatimin n\u00eb qarkulim e cila do t\u00eb pasoj\u00eb si obligim pas lidhjes s\u00eb kontrat\u00ebs p\u00ebr tjet\u00ebrsimin e tok\u00ebs nd\u00ebrimore dhe t\u00eb dor\u00ebzoj\u00eb d\u00ebshmi p\u00ebr realizimin e pages\u00ebs.<br>29.Harxhimet e procedur\u00ebs s\u00eb noterit dhe bartjes n\u00eb evidec\u00ebs s\u00eb patundshm\u00ebrive n\u00eb Agjensionin p\u00ebr kadast\u00ebr t\u00eb patundshm\u00ebrive bien si ngarkes\u00eb e bler\u00ebsit t\u00eb tok\u00ebs nd\u00ebrtimore.<br>30.Gjat\u00eb procedur\u00ebs s\u00eb ankandit publik pjes\u00ebmarsit kan\u00eb t\u00eb drejt\u00eb t\u00eb ankes\u00ebs n\u00eb afat prej 3 (tre) dit\u00ebve nga dita e mbajtjes s\u00eb ankandit publik. Ankesa parashtrohet n\u00eb m\u00ebnyr\u00eb t\u00eb shkruar deri te Komisioni I cili vendos p\u00ebr ankes\u00ebn me Aktvendim.
